Product Warranty
Finer Surfaces, Inc., ("Finer Surfaces") warrants to the purchasers of its products that such products are free from manufacturing defects for three years.
Finer Surfaces, does not warrant or guarantee the workmanship of any person or firm that installs its products.
Finer Surfaces' obligation under this warranty is limited solely to the original, full paid purchaser and solely to replacement in kind of any Finer Surfaces product which may prove defective in manufacturing within three years from date of installation, provided the product was stored correctly and installed properly within the product's shelf life, by the original purchaser and subject to examination by Finer Surfaces for compliance with these terms, and whose decision shall be binding on the claimant.
IN NO EVENT SHALL FINER SURFACES BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES. THIS WARRANTY IS EXPRESSLY GIVEN IN LIEU OF ALL OTHER WARRANTIES EXPRESSED OR IMPLIED. FINER SURFACES MAKES NO WARRANTY, EXPRESS OR IMPLIED OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR USE.
Finer Surfaces neither assumes nor authorizes any person or persons to assume for it any other liability in connection with the sale of a Finer Surfaces product.
This warranty shall not apply to any of Finer Surfaces' products which have been subject to adulteration, alteration, abuse or misuse.
Finer Surfaces makes no warranty whatsoever with respect to accessories, parts or materials not supplied by Finer Surfaces which are used in connection with its products.
The term “original purchaser” in this warranty means that person, corporation or entity to whom Finer Surfaces sold its product or products.
Any action to enforce any warranty or for breach of contract or arising out of any claim against Finer Surfaces shall be commenced and maintained only in the Superior Court of Clark County, Washington State, United States of America.
